1. GENERAL REFUND POLICY
LuxeShine provides service-based, labor-based, rental-based, and custom project services. As a result, payments are not treated in the same manner as ordinary retail purchases.
Once LuxeShine has committed labor, equipment, vehicles, rental inventory, materials, disposal capacity, subcontractors, scheduling time, administrative resources, or other costs toward a customer's project, some or all payments may become non-refundable to the extent permitted by applicable law and the customer's applicable service agreement.
Refund eligibility depends upon:
-
The type of service;
-
When cancellation is requested;
-
Whether work has begun;
-
Whether crews or equipment have been dispatched;
-
Whether materials have been purchased;
-
Whether equipment or rental inventory has been reserved;
-
Whether third-party expenses have been incurred;
-
Whether disposal, delivery, permitting, transportation, or subcontractor expenses have been incurred;
-
The amount of work already completed; and
-
Applicable federal, state, and local law.
Nothing in this Policy eliminates or limits any cancellation, refund, warranty, or other consumer right that cannot legally be waived.
2. ESTIMATES & QUOTES
Unless otherwise stated, basic LuxeShine estimates may be provided without charge.
Certain services may require:
-
On-site consultations;
-
Detailed measurements;
-
Design work;
-
Project planning;
-
Engineering or specialist review;
-
Material sourcing;
-
Diagnostic services;
-
Travel outside LuxeShine's standard service area; or
-
Detailed written project proposals.
If LuxeShine charges an estimate, consultation, design, diagnostic, or planning fee, that fee will be disclosed before the service is performed.
Fees for services already performed are generally non-refundable, except where otherwise required by law or expressly agreed to in writing.
An estimate does not guarantee a final project price when conditions unknown or not reasonably observable at the time of the estimate materially change the scope of work.
3. DEPOSITS & PROJECT RESERVATIONS
Certain LuxeShine projects may require a deposit or other initial payment.
Deposits may be used to reserve:
-
Crew availability;
-
Project dates;
-
Vehicles;
-
Trailers;
-
Dumpsters;
-
Machinery;
-
Specialized equipment;
-
Materials;
-
Subcontractors;
-
Delivery capacity; or
-
Other project resources.
For California home-improvement projects, any deposit and payment schedule will be handled in accordance with applicable California law and the applicable written home-improvement contract.
Where California home-improvement contract requirements apply, the project's written contract and legally required cancellation notice supersede conflicting provisions of this general website Policy.
4. CUSTOMER CANCELLATIONS
Customers should notify LuxeShine of a cancellation as soon as reasonably possible.
For ordinary services that are not governed by a different written contract or statutory cancellation requirement, LuxeShine may apply the following general scheduling policy:
More Than 72 Hours Before Service
Customers cancelling more than 72 hours before the scheduled service may be eligible for a refund or service credit for amounts not already committed to non-refundable expenses.
Any materials, permits, special orders, third-party charges, processing expenses, equipment reservations, or other project-specific expenses already incurred may be deducted where permitted by law.
24–72 Hours Before Service
Cancellations within 24–72 hours may be subject to a scheduling or cancellation charge where disclosed and legally permitted.
LuxeShine may alternatively offer a service credit or rescheduling option.
Less Than 24 Hours Before Service
For ordinary services, cancellations made less than 24 hours before the scheduled arrival may be non-refundable or subject to a late-cancellation fee where permitted by law and the applicable service agreement.
Same-Day Cancellation
Once a LuxeShine crew, vehicle, dumpster, equipment, or subcontractor has been dispatched, mobilization, transportation, labor, delivery, rental, and other costs already incurred may be charged to the customer.
These general cancellation provisions do not override any statutory cancellation right or different cancellation terms contained in an applicable written contract.
5. CALIFORNIA HOME-IMPROVEMENT CANCELLATION RIGHTS
Certain LuxeShine landscaping, hardscaping, construction, repair, installation, renovation, and property-improvement services may qualify as home-improvement work under California law.
Where applicable, customers will receive the legally required home-improvement contract and Notice of Cancellation.
A qualifying customer may have a statutory right to cancel a home-improvement transaction within the applicable cancellation period without penalty.
Certain California consumers age 65 or older may receive an extended cancellation period where required by law.
Exceptions may apply, including certain qualifying service-and-repair or emergency transactions and transactions negotiated under circumstances excluded by applicable law.
The customer's project-specific contract and legally required Notice of Cancellation govern these rights.
Nothing contained on LuxeShine.co is intended to waive, restrict, replace, or discourage a customer's statutory right to cancel a transaction where such right applies.
6. LANDSCAPING & LAWN SERVICES
Landscaping services frequently involve labor, equipment mobilization, purchased materials, disposal costs, and project-specific scheduling.
Once landscaping work has begun, refunds generally will not be issued for work properly completed.
If a customer believes work materially differs from the agreed scope, the customer should contact LuxeShine promptly and allow LuxeShine a reasonable opportunity to inspect and, where appropriate, correct the issue.
Customer dissatisfaction based solely upon a change in personal preference after properly authorized work has been completed does not automatically qualify for a refund.
7. PLANTS, SOD, TREES & LIVING MATERIALS
Plants, trees, shrubs, flowers, sod, and other living materials are affected by weather, irrigation, soil conditions, pests, animals, customer maintenance, and other environmental conditions outside LuxeShine's control.
Once installed or delivered, living materials generally cannot be returned.
Any plant or workmanship warranty specifically offered by LuxeShine must be stated in the applicable proposal, invoice, contract, or warranty.
Unless expressly warranted in writing, LuxeShine does not guarantee the survival of plants affected by:
-
Insufficient watering;
-
Excessive watering;
-
Irrigation failure;
-
Extreme heat or cold;
-
Drought;
-
Frost;
-
Disease;
-
Pests;
-
Animals;
-
Customer neglect;
-
Soil conditions;
-
Acts of nature; or
-
Unauthorized modification or relocation.
Nothing in this section limits warranties or remedies that cannot legally be excluded.
8. CUSTOM & SPECIAL-ORDER MATERIALS
Custom, made-to-order, specially sourced, cut-to-size, personalized, or project-specific materials may be non-returnable after they have been ordered where permitted by law.
Examples include custom:
-
Stone;
-
Pavers;
-
Lumber;
-
Fixtures;
-
Paint colors;
-
Fabricated components;
-
Irrigation equipment;
-
Lighting;
-
Signage;
-
Holiday displays;
-
Specialty plants; and
-
Other project-specific materials.
If a supplier accepts a return, LuxeShine may pass through any supplier restocking, freight, delivery, pickup, or return charges where permitted by law and disclosed or authorized under the applicable agreement.
9. DUMPSTER RENTALS
Dumpster rentals involve reserved equipment, transportation, disposal capacity, and landfill or transfer-station charges.
Once a dumpster has been delivered to the customer's property or designated location, the rental is considered to have commenced.
Refunds generally will not be provided for:
-
Unused dumpster capacity;
-
A dumpster filled less than expected;
-
Early completion of a cleanup;
-
Customer deciding the dumpster is no longer needed after delivery; or
-
Customer inability to use the dumpster due to circumstances outside LuxeShine's control.
If LuxeShine is unable to deliver a dumpster and cannot provide a reasonable alternative, the customer may receive a refund for the affected unperformed rental service.
10. DUMPSTER CANCELLATIONS
Dumpster cancellations should be made before dispatch.
Once a dumpster has been loaded for delivery, dispatched, or delivered, applicable delivery, transportation, rental, and mobilization charges may become non-refundable.
A failed delivery caused by customer-provided conditions may result in a trip or attempted-delivery charge.
Examples include:
-
Inaccessible property;
-
Locked gates;
-
Vehicles blocking placement;
-
Unsafe placement conditions;
-
Insufficient clearance;
-
Customer absence where access is required; or
-
Incorrect delivery information.
11. DUMPSTER WEIGHT & OVERAGE FEES
Dumpster pricing may include a specified weight allowance.
Customers are responsible for charges exceeding the included weight allowance.
Additional charges may include:
-
Excess weight;
-
Additional rental days;
-
Additional pickups;
-
Relocation;
-
Failed pickup attempts;
-
Prohibited materials;
-
Special handling;
-
Contamination;
-
Mattress or appliance fees;
-
Tire fees;
-
Hazardous-material handling;
-
Government disposal fees; and
-
Landfill or transfer-station surcharges.
Where possible, these fees will be disclosed in the rental agreement or booking terms.
12. PROHIBITED DUMPSTER MATERIALS
Customers may not place prohibited, illegal, hazardous, toxic, flammable, explosive, or otherwise restricted materials into LuxeShine dumpsters unless LuxeShine has expressly agreed in writing to accept the material and is legally authorized to do so.
Customers may be responsible for costs resulting from prohibited materials, including sorting, cleanup, disposal, fines, transportation, environmental charges, or other expenses.
13. MOVING SERVICES
Moving services are time-, labor-, transportation-, and equipment-dependent.
Once movers have arrived at the scheduled location, the booked service is considered to have commenced.
Charges may include:
-
Crew time;
-
Travel time;
-
Loading;
-
Unloading;
-
Packing;
-
Furniture assembly/disassembly;
-
Equipment;
-
Mileage;
-
Transportation;
-
Specialty handling; and
-
Other agreed services.
Unused time from a minimum booking period is generally not refundable.
14. MOVING CANCELLATIONS & RESCHEDULING
Moving appointments reserve labor, vehicles, and equipment that may otherwise have been booked by another customer.
Late cancellation or rescheduling may therefore result in cancellation, rescheduling, or mobilization charges where disclosed and legally permitted.
Weather, road closures, emergencies, unsafe working conditions, or circumstances beyond reasonable control may require rescheduling.
LuxeShine will make reasonable efforts to provide an alternative service date when appropriate.
15. CUSTOMER-PACKED PROPERTY
Unless otherwise required by law or specifically agreed in writing, LuxeShine is not responsible for concealed damage resulting from inadequate customer packing or pre-existing damage.
Customers should disclose fragile, unusually valuable, oversized, hazardous, or specialty items before the move.
Items requiring special handling may require additional charges or separate written authorization.
16. JUNK REMOVAL & PROPERTY CLEANOUTS
Once items have been removed from a property and transported for disposal, recycling, donation, or processing, the transaction is generally final.
Customers are responsible for identifying items that should not be removed.
LuxeShine is not responsible for a customer mistakenly authorizing removal of an item the customer later decides they wanted to retain, except to the extent otherwise required by law.
Customers should inspect the work area before final removal whenever practical.
17. HAULING & DISPOSAL
Disposal and hauling charges may be based upon:
-
Volume;
-
Weight;
-
Labor;
-
Equipment;
-
Mileage;
-
Disposal fees;
-
Material type;
-
Accessibility; and
-
Special handling.
Actual disposal costs may differ from initial estimates when the amount, weight, or type of material differs from information originally provided by the customer.
18. CONSTRUCTION, REPAIR & HANDYMAN SERVICES
Construction, repair, installation, handyman, and improvement services may require project-specific contracts.
Refunds will not ordinarily be issued for properly completed work simply because a customer later changes their mind about an approved design, material, color, placement, configuration, or scope.
If LuxeShine determines that completed work materially fails to conform to the agreed scope or applicable warranty, LuxeShine may, as appropriate:
-
Inspect the work;
-
Repair or correct the affected work;
-
Replace defective work or materials;
-
Provide a reasonable service credit; or
-
Issue an appropriate partial or full refund where warranted or legally required.
The appropriate remedy will depend upon the circumstances and applicable law.
19. CHANGE ORDERS
Changes to the original scope may affect:
-
Price;
-
Materials;
-
Labor;
-
Equipment;
-
Schedule; and
-
Completion date.
Where a written change order is legally required, work outside the original scope will not proceed until the required authorization has been obtained.
Customers are responsible for approved additional work and materials.
20. PRESSURE WASHING & EXTERIOR CLEANING
Pressure washing and cleaning results depend upon the condition, age, composition, and previous treatment of the surface.
Certain stains, oxidation, discoloration, paint deterioration, mineral deposits, organic growth, or permanent surface damage may not be completely removable.
A refund is not automatically available because a pre-existing condition remains visible after reasonable professional cleaning.
21. SEASONAL & HOLIDAY SERVICES
Holiday lighting, decorating, Christmas tree installation, seasonal cleanup, and similar services may require advance purchasing and reservation of limited seasonal labor.
Custom-purchased or customer-specific holiday materials may be non-refundable where permitted by law.
Cancellation after materials have been ordered or installation has begun may result in charges for costs already incurred.
22. RECURRING MAINTENANCE SERVICES
Recurring landscaping, lawn, cleaning, or property-maintenance plans may be cancelled according to the applicable service agreement.
Cancellation does not eliminate charges for services already completed.
If a plan automatically renews or continues until cancelled, LuxeShine will provide required disclosures, obtain required consent, and provide legally required cancellation mechanisms in accordance with applicable law.
23. WEATHER DELAYS
Landscaping, moving, hauling, construction, dumpster delivery, and outdoor services may be affected by:
-
Rain;
-
High winds;
-
Extreme heat;
-
Fire conditions;
-
Flooding;
-
Snow or ice;
-
Road closures;
-
Government restrictions;
-
Unsafe site conditions; or
-
Other circumstances beyond LuxeShine's reasonable control.
A weather delay does not automatically constitute a cancellation or entitle the customer to a refund.
LuxeShine may reschedule affected services to the next reasonably available date.
24. CUSTOMER SITE CONDITIONS
Customers are responsible for disclosing known conditions that could materially affect the work, including:
-
Underground utilities;
-
Septic systems;
-
Irrigation lines;
-
Property boundaries;
-
HOA restrictions;
-
Access restrictions;
-
Pets;
-
Hazardous materials;
-
Unstable structures;
-
Electrical hazards;
-
Drainage problems; and
-
Other known site hazards.
Undisclosed conditions may result in additional costs, delays, change orders, or suspension of work.
25. PERMITS & HOA APPROVALS
Where the customer is responsible for obtaining permits, HOA approvals, landlord authorization, parking permits, dumpster permits, or other permissions, failure to obtain those approvals does not automatically entitle the customer to a refund for expenses LuxeShine has already incurred.
Responsibility for permits and approvals should be identified in the applicable agreement.
26. ACCESS & FAILED SERVICE CALLS
Customers must provide reasonable access to the service location at the scheduled time.
If LuxeShine cannot perform the service because of:
-
Locked access;
-
Customer absence;
-
Unsafe conditions;
-
Aggressive animals;
-
Blocked work areas;
-
Incorrect address information;
-
Utility interruption;
-
Lack of required authorization; or
-
Other customer-controlled circumstances,
LuxeShine may charge a trip, mobilization, cancellation, or rescheduling fee where permitted by law and the applicable agreement.
27. SERVICE QUALITY CONCERNS
LuxeShine wants the opportunity to address legitimate service concerns.
Customers should report a service issue as soon as reasonably possible after discovering it and provide:
-
Customer name;
-
Service address;
-
Date of service;
-
Description of the issue;
-
Photographs or video when relevant; and
-
Requested resolution.
LuxeShine may request an opportunity to inspect the affected work before determining the appropriate remedy.
28. REFUNDS VS. CORRECTIVE SERVICE
Where legally permitted, LuxeShine may determine that correcting, repairing, replacing, or completing the affected service is the appropriate remedy rather than issuing an immediate refund.
If LuxeShine can reasonably correct an issue, customers agree to provide reasonable access and opportunity for LuxeShine to inspect and address the concern.
This provision does not limit remedies that the customer is entitled to under applicable law.
29. REFUND CALCULATIONS
When a partial refund is appropriate, LuxeShine may calculate the refundable amount based upon the unperformed portion of the service after deducting legally permissible amounts attributable to:
-
Work already completed;
-
Labor already performed;
-
Materials already purchased or installed;
-
Non-returnable materials;
-
Equipment already used or reserved;
-
Transportation;
-
Delivery;
-
Disposal fees;
-
Permit fees;
-
Third-party charges;
-
Custom orders;
-
Subcontractor costs; and
-
Other documented project expenses.
Any calculation remains subject to applicable law and the governing service agreement.
30. REFUND METHOD
Approved refunds will generally be returned to the original payment method whenever reasonably possible.
Processing time depends upon the financial institution, payment processor, and original payment method.
LuxeShine is not responsible for delays caused solely by banks, card issuers, payment processors, or other financial institutions after LuxeShine has submitted an approved refund.
31. CREDIT CARD DISPUTES & CHARGEBACKS
Customers experiencing a billing or service issue are encouraged to contact LuxeShine first so the matter can be reviewed promptly.
Nothing in this Policy prevents a customer from exercising lawful rights relating to a payment dispute.
LuxeShine reserves the right to provide contracts, invoices, photographs, communications, proof of delivery, service records, signed approvals, time records, disposal receipts, and other relevant documentation to a payment processor or financial institution in response to a chargeback or payment dispute.
32. CUSTOMER-SUPPLIED MATERIALS
When a customer supplies materials, LuxeShine is generally not responsible for defects, shortages, incompatibility, incorrect specifications, manufacturing defects, or failure of those customer-supplied materials.
Additional labor resulting from defective or incorrect customer-supplied materials may be separately chargeable.
33. THIRD-PARTY PRODUCTS & MANUFACTURER WARRANTIES
Products and equipment supplied by third-party manufacturers may be subject to manufacturer warranties.
Where applicable, LuxeShine may assist the customer with identifying the appropriate warranty process, but the manufacturer's warranty terms remain separate from LuxeShine's workmanship obligations.
34. PROPERTY DAMAGE CLAIMS
Any alleged property damage should be reported to LuxeShine promptly after discovery.
Customers should preserve the affected condition and provide photographs or other documentation when reasonably possible.
LuxeShine may inspect the property and investigate the circumstances before determining responsibility or proposing a resolution.
35. ABANDONED OR SUSPENDED PROJECTS
If a customer instructs LuxeShine to stop work after work has commenced, the customer remains responsible for amounts legally due for completed work and authorized costs already incurred.
Any refund of prepaid amounts will be calculated according to applicable law, the governing contract, and the portion of work remaining.
36. LUXESHINE CANCELLATIONS
If LuxeShine must permanently cancel a service before performing any work and cannot provide a reasonable rescheduled date or alternative, the customer will generally receive a refund of amounts paid for the unperformed service.
This does not necessarily include separately authorized and non-refundable third-party expenses already incurred for the customer's project where permitted by law.
37. FORCE MAJEURE & EVENTS BEYOND REASONABLE CONTROL
LuxeShine is not responsible for delays caused by circumstances reasonably beyond its control, including severe weather, wildfire, natural disaster, government order, utility failure, road closure, supply-chain disruption, labor interruption, equipment failure despite reasonable maintenance, or similar events.
Where possible, LuxeShine will work with the customer to reschedule or otherwise reasonably resolve the affected service.
38. PROMOTIONS, DISCOUNTS & SERVICE CREDITS
Promotional offers, coupons, discounts, complimentary upgrades, and service credits have no cash value unless expressly stated otherwise.
If a transaction receiving a promotional discount is partially refunded, any refund may be calculated using the actual discounted amount paid rather than the standard retail value.
Service credits may be subject to reasonable expiration dates or restrictions disclosed when issued, subject to applicable law.
39. NON-REFUNDABLE ITEMS
Subject to applicable law and the customer's governing agreement, the following may be non-refundable once incurred, performed, delivered, ordered, installed, or committed:
-
Completed labor;
-
Mobilization expenses;
-
Delivery charges;
-
Disposal charges;
-
Permit fees;
-
Custom materials;
-
Special-order materials;
-
Used materials;
-
Installed materials;
-
Design or consultation services already performed;
-
Equipment already deployed;
-
Dumpster rentals already delivered;
-
Moving services already performed;
-
Third-party charges;
-
Approved subcontractor costs; and
-
Other documented project-specific expenses.
40. NO GUARANTEE OF SUBJECTIVE RESULTS
LuxeShine strives to deliver high-quality work consistent with the agreed scope.
However, landscaping, construction, cleaning, restoration, property improvement, and aesthetic work may involve subjective preferences.
Approval of materials, layouts, colors, finishes, designs, placement, or other aesthetic selections may limit the customer's ability to request a refund solely because the customer later changes their preference.
This does not excuse defective workmanship or eliminate applicable warranties.
41. PHOTOGRAPHIC DOCUMENTATION
LuxeShine may document property conditions before, during, and after services for legitimate business purposes, including:
-
Project documentation;
-
Quality assurance;
-
Scope verification;
-
Damage documentation;
-
Customer disputes; and
-
Warranty claims.
Any marketing use of customer property images should be handled separately in accordance with LuxeShine's privacy and media-consent practices.
42. WRITTEN PROJECT AGREEMENTS CONTROL
This website Policy establishes general rules applicable across LuxeShine services.
Certain services may include a separate:
-
Estimate;
-
Proposal;
-
Work order;
-
Rental agreement;
-
Moving agreement;
-
Home-improvement contract;
-
Service agreement;
-
Maintenance agreement;
-
Change order; or
-
Other written contract.
If a project-specific agreement contains terms that differ from this Policy, the project-specific agreement will control to the extent legally enforceable.
Any mandatory federal, California, county, or local consumer-protection requirement will control over conflicting language in either document.
43. CALIFORNIA CONSUMER RIGHTS
Nothing in this Policy is intended to waive any non-waivable right provided by California or federal law.
Where a legally required cancellation period, refund requirement, warranty, disclosure, notice, or remedy applies, LuxeShine will honor that requirement regardless of any general provision contained in this Policy.
44. HOW TO REQUEST A CANCELLATION OR REFUND
To request a cancellation, refund, service credit, or review of a service concern, customers should contact LuxeShine through the contact information published on LuxeShine.co or through the communication method identified in their service agreement.
Please provide:
-
Full name;
-
Service address;
-
Phone number or email associated with the booking;
-
Invoice, estimate, or project number when available;
-
Date of service;
-
Amount paid;
-
Reason for the request; and
-
Supporting photographs or documentation when applicable.
Requests will be reviewed based upon the service performed, governing agreement, documented expenses, circumstances of the request, and applicable law.
45. POLICY ACCEPTANCE
By booking, purchasing, reserving, or authorizing a LuxeShine service, the customer acknowledges that they have had an opportunity to review the applicable terms presented in connection with the transaction.
Acceptance of this website Policy does not replace any signature, disclosure, contract, cancellation notice, or other document separately required by law.
46. POLICY UPDATES
LuxeShine may update this Policy periodically to reflect changes to services, business practices, or applicable law.
The version applicable to a transaction will generally be the version presented or incorporated into the customer's agreement at the time of booking or contracting, except where subsequent changes are required by law.
THE LUXESHINE COMMITMENT
LuxeShine believes strong customer relationships are built through clear expectations, quality workmanship, professional communication, and fair resolution of legitimate concerns.
Our goal is not simply to complete a job—it is to provide dependable property solutions while protecting our customers, crews, equipment, and business from misunderstandings.
